When Will Courts Compel a Defendant to Disclose Access to Material Posted On a Social Networking Site?
The proliferation of social media has opened up new avenues for defendants to collect evidence about parties filing claims against them. This has left courts to determine the proper balance between maintaining a plaintiff’s right of privacy and a defendant’s...

The Nissenbaum Law Group also offers two unique services for attorneys: representing them in responding to ethics grievances and serving as an expert witness in such proceedings. The managing principal of the firm, Gary D. Nissenbaum, Esq., has extensive experience in handling such matters.

Defense of Attorney Ethics Matters

Mr. Nissenbaum was previously a member of the District XII Ethics Committee for five years. Ultimately, he was honored to be appointed as its Vice Chair and later, the Chairman, of the Committee in 2006/2007.

Prior to his service on the Committee, Mr. Nissenbaum defended an attorney accused of serious legal ethics infractions in a multi-day trial in which the defendant was found innocent. While he was not permitted to defend attorneys accused of ethics violations during his tenure on the Committee, Mr. Nissenbaum gained invaluable experience investigating ethics violations; supervising such investigations; and chairing a hearing relating to serious allegations of ethical infractions by an attorney. As of September 1, 2007, Mr. Nissenbaum completed his tenure as Chairman of the District XII Ethics Committee. Consequently, he is permitted to again defend attorneys accused of ethical infractions.

Expert Witness in Legal Ethics Matters.

Due to his extensive background in both commercial practice and in the attorney ethics process, Mr. Nissenbaum is uniquely suited to serve as an expert witness in legal ethics proceedings. He has prepared numerous expert witness reports for plaintiff's attorneys alleging professional negligence. Mr. Nissenbaum is also available to testify as an expert witness in fee arbitration matters.
