EMPLOYMENT BENEFITS & HEARINGS

In the era of the COVID-19 coronavirus, otherwise straightforward decisions on whether or not an employee is entitled to benefits can become highly complex. It is critical that a business have access to employment counsel for advice.

Employment Benefits & Administrative Proceedings

There has been a dramatic, nationwide increase in employers who are the target of accusations relating to failure to properly withhold payroll. Given the COVID-19 coronavirus pandemic, this will likely increase.

The issue of whether an employee is entitled to employment benefits can be affected by everything from the work performed, oral or written representations by the employer, the terms under which employees are being terminated or furloughed and even safety protocols concerning potential exposure to the coronavirus in the workplace In addition to all that, there is also the simple question of whether someone has a right to employee benefits in the first place—especially as new government programs come on-line without much guidance.

While some of these matters can be resolved internally between the employer and employee, others may result in a complaint being filed with an agency such as the state or federal Department of Labor. After that, it can become a full-blown hearing and even land in the judicial courts. Given all that, there is a pressing need in the current commercial environment for businesses to have employment benefits law counsel.

The Nissenbaum Law Group represents employers who are the target of investigations, hearings and/or court proceedings relating to the regulations that govern the employment relationship, including such matters as:

  • Advising employers and employees with regard to compliance with IRS and state-specific statutes and regulations concerning whether to characterize a worker as an employee or independent contractor;
  • Providing business counseling to assist in the development of best practices and other human resource policies and procedures aimed at minimizing legal risk; and
  • Litigating before the relevant administrative agencies, and if necessary, the State and Federal Courts.
